ICANN Files Legal Action in Germany to Preserve WHOIS Data
LOS ANGELES – 25 May 2018 – The Internet Corporation for Assigned Names and Numbers (ICANN) today filed injunction proceedings against EPAG, a Germany-based, ICANN-accredited registrar that is part of the Tucows Group. ICANN has taken this step to ask the court for assistance in interpreting the European Union's General Data Protection Regulation (GDPR) in order to protect the data collected in WHOIS. ICANN's "one-sided filing" in Bonn, Germany, seeks a court ruling to ensure the continued collection of all WHOIS data, so that such data remains available to parties demonstrating legitimate purpose to access it, consistent with the GDPR.


Tucows Statement on ICANN Legal Action
On Friday the 25th of May, ICANN filed a legal action against EPAG Domainservices GmbH, a Tucows-owned Registrar based in Bonn, Germany. This action was taken because of a disagreement between Tucows and ICANN on how the GDPR should be interpreted, with respect to our contracts. While we look forward to defending our position in court, the below is intended to provide some context and insight into the dispute.

tucows concealed all the whois data, except for reseller info. i believe this happened on the 25th. which makes a little more work for ssl certs, because email bssed domain auth can only happen with an email based on a domain. or can use http based. either way is going to add maybe up to 15 minutes to the process?.

tucows did not ask me they just did it, not sure if there is an opt out? of back in lol

apparently i was not the only person annoyed by this whois data change, with regards to SSL certificates.

Purpose of Ballot: Increasingly, contact information is not available in WHOIS due to concerns about potential GDPR violations. This ballot specifies a method by which domain holders can publish their contact information via DNS, and how CAs can use that information for validating domain control.
